EACH MINOR PARTICIPATING IN THE DESTINATION BROADWAY SUMMER INTENSIVE PROGRAM MUST HAVE A PARENT OR LEGAL GUARDIAN’S SIGNATURE BELOW IN ORDER TO PARTICIPATE.

I do hereby acknowledge that the Destination Broadway Summer Intensive program includes physical activity (singing, dancing, performing) presents the risk of certain risks (including but not limited to brain injury, severe bodily harm and/or death), and I knowingly and voluntarily assume all risks associated with the Destination Broadway Summer Intensive and waive all claims for injury, damage, or loss to my child, myself and my property during my child’s participation at Destination Broadway Summer Intensive program (hereinafter “Destination Broadway”) and release the owners, teachers, authorized agents and employees of DESTINATION BROADWAY, LLC and The Academy of Dance and Gymnastics from any and all liability for injury, damage or loss which may be caused by any act or omission of any of them.I understand that Destination Broadway may from time to time produce promotional and other materials related to its events. I understand that as a participant in the event, the minor listed below may be included in videotapes, DVDs, social media and/or photographs taken at the event. Therefore, on my own behalf and on behalf of the minor participant, I transfer and grant Destination Broadway the right to photograph and videotape the minor listed below andallow Destination Broadway to utilize the material with or without the minor’s name for any and all purposes.In addition to those acknowledgements and waivers contained herein above, and in consideration of being allowed to participate in the event identified above, the undersigned acknowledges, appreciates, and agrees that:

 

1.Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,

 

2.I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases, including but not limited to Destination Broadway Policies and Procedures; and,

 

4.I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS DESTINATION BROADWAY, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY PARTICIPATING IN THE DESTINATION BROADWAY SUMMER INTENSIVE PROGRAM, AND AGREE TO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
